TERMS AND CONDITIONS OF USE 

Welcome to our website www.acensi.group (hereinafter referred to as the «Site») offered by ACENSI SAS.  

Use of the www.acensi.group website implies full acceptance of the general conditions of use described below (hereinafter referred to as the «Conditions»). These Terms of Use may be amended or supplemented at any time, and Site Users are therefore advised to consult them regularly. 

The Site is regularly updated by ACENSI. In the same way, the legal notices may be modified at any time: they are nevertheless binding on the User, who is invited to refer to them as often as possible in order to take cognizance of them.

2. Definitions

3. Description of services provided 

The purpose of the Site is to present the activities of ACENSI SAS. ACENSI SAS endeavors to publish accurate and up-to-date information on this Site. However, ACENSI SAS cannot be held responsible for any omissions, inaccuracies or omissions, whether caused by ACENSI SAS or by third-party partners supplying such information. 

All information on this site is given for guidance only and is subject to change. Furthermore, the information contained on the Site is not exhaustive, and is subject to modifications having been made since it was put on line. 

4. Intellectual property rights 

The elements present on the Site (photographs, texts, slogans, trademarks, logos, drawings, images, databases, animated sound sequences, etc.) as well as the Site's source code are the property of ACENSI SAS or of third parties having authorized ACENSI SAS to use them. 

Any use, partial or total, of the Site - in particular by downloading, reproduction, transmission, representation or broadcasting - for purposes other than personal and private, whether commercial or not, is strictly forbidden. 

It is also forbidden to extract or reuse, without prior written authorization from ACENSI SAS, substantial parts, both quantitatively and qualitatively, of the content of any of the databases present on the Site, whether or not these are protected by articles L.341-1 et seq. of the French Intellectual Property Code. 

Any unauthorized use of the Site or any of its elements constitutes an infringement and may be prosecuted in accordance with articles L.335-2 et seq. of the French Intellectual Property Code. Non-compliance with these provisions exposes the User to the penalties provided for by law. 

By using the sharing functionality offered on the Site to recommend a product, an event or any communication from ACENSI SAS, you acknowledge that the content shared may only be used for strictly personal purposes. Any use for commercial purposes, in particular on websites, social networks or any other commercial digital medium, is strictly forbidden. 

5. Hyperlinks 

ACENSI SAS authorizes the creation of hypertext links to the content of its Site, subject to compliance with the following conditions:

  • No use of the deep-linking technique (« deep linking »This means that the Site's pages must not be integrated into the pages of another site, but must be accessible via the opening of a new, dedicated window; ;

This authorization does not apply to websites containing polemical, pornographic or xenophobic content, or content likely to offend the public. 

Furthermore, websites containing links to the Site are neither edited nor controlled by ACENSI SAS. Consequently, ACENSI SAS declines all responsibility for the content, availability or accuracy of the information published on these external sites. Use of these sites is therefore your sole responsibility. 

6. Liability 

ACENSI SAS may only be held liable in the event of fault, negligence or breach of its obligations having directly caused damage to the User. 

The Site uses PHP technology. ACENSI SAS cannot be held responsible for any material damage resulting from the use of the Site. 

The information accessible via the Site is provided «as is». ACENSI SAS does not guarantee its accuracy or completeness, and declines all responsibility in the event of errors or omissions. The User is solely responsible for the use he makes of this information and undertakes not to transmit, via the Site, any content that may give rise to civil or criminal liability. In this respect, the User undertakes not to publish any content that is illegal, contrary to public order or defamatory. 

ACENSI SAS also declines all responsibility in the event of malfunction, unavailability or incorrect use of the Site, as well as in the event of technical incidents, computer errors or defects observed. ACENSI SAS cannot be held responsible for any damage, direct or indirect, caused to the User's equipment when accessing the Site. 

7. Modification of conditions 

ACENSI SAS reserves the right to modify these Terms at any time. 

8. Personal data 

ACENSI SAS is an international group headquartered in France. In terms of information security and confidentiality, the technical and organizational measures implemented comply with the requirements of our ISO 27001 certification, as well as with Regulation (EU) 2016/679, known as the General Data Protection Regulation (GDPR).

9. Transfer of rights and obligations 

The User undertakes not to assign or transfer, in any manner whatsoever, all or part of the rights and obligations resulting from the present General Conditions of Use, except with the prior, express and written consent of ACENSI SAS. On the other hand, ACENSI SAS reserves the right to freely assign or transfer the present Terms to any third party of its choice, in particular in the context of a restructuring, merger or acquisition operation, provided that such assignment does not entail any reduction in the rights granted to the User under the present Terms. 

10. Applicable law and competent courts 

The present Conditions are subject to French law, without any conflict of laws rule being applicable.  

The courts of Paris shall have exclusive jurisdiction over any dispute arising from the use of the Site, or the interpretation, performance, termination or expiry of the Conditions. 

11. Severability clause 

If any provision of these Terms, including this clause, is declared wholly or partially invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, unless the invalidated provision has been determined to be an essential obligation of ACENSI SAS. 

In place of unenforceable or invalid stipulations, legal provisions will apply.
